The specific services included in any engagement will be outlined in a separate written agreement ("Project Agreement") between you and American Web Store. This agreement will detail the scope of work, deliverables, timelines, costs, and other relevant project details.

Project Delivery

Record Maintenance: We understand the importance of maintaining access to your project deliverables. After project completion, we will maintain a record of your finalized project files, including website design files and marketing assets, for a reasonable period. You can request these files again at any time, free of charge.

Turnaround Time: The turnaround time for project deliverables will be clearly specified in the Project Agreement. It is important to distinguish between turnaround time and total project completion. Turnaround time typically refers to the completion of a single design iteration or service stage (e.g., initial website design mockups, SEO keyword research report). Revisions may require additional time as outlined in the Project Agreement. We strive to communicate project timelines effectively and keep you informed throughout the development process.

Communication Policy

Effective communication is crucial for a successful project. To ensure clear and efficient communication, all communication regarding your project, including feedback requests, revision requests, questions, and other instructions, should be submitted through our designated platform (e.g., project management portal) or via email to a designated point of contact. This centralized communication approach allows us to properly document and track all project interactions.

We will designate a primary point of contact for your project who will be responsible for managing communication and keeping you updated on project progress. Our team will respond to your communications in a timely manner during our regular business hours.

Customer Support

American Web Store recognizes the importance of providing ongoing support to our clients. The specific scope and availability of customer support will be outlined in the Project Agreement. Our customer support team can assist you with basic inquiries, troubleshoot minor issues, and answer questions related to your online store management. For ongoing technical maintenance or complex technical issues, separate service packages may be available.

Content Creation & Population

Unless explicitly included in the Project Agreement, American Web Store is not responsible for creating or populating your online store with content (product descriptions, blog posts, images, videos). High-quality content is essential for a successful online store, and we can provide recommendations or referrals for reputable content creation services if needed.

N.D.A. & Reputation Management Policy

Non-Disclosure Agreement (NDA): American Web Store takes client confidentiality seriously. We will maintain an NDA with you to protect your confidential information, including project details, strategies, and data. We will not share this information with any third party without your prior written consent.

Reputation Management: Both parties agree to act in a professional and respectful manner throughout the course of the project and beyond. We will not intentionally disparage or defame each other in any public forum or communication.

Technical Support Policy

American Web Store primarily focuses on providing e-commerce solutions and marketing services. The extent of technical support offered will vary depending on the service package you select.

Basic Technical Support: Our team can provide basic technical support related to your online store functionality, such as troubleshooting plugin issues or setting up email accounts.

Advanced Technical Support: For ongoing website maintenance, security updates, or complex technical issues, we may offer separate service packages. These packages may include website monitoring, performance optimization, and server management.

Domain and Hosting

Project Deliverables: Upon project completion, we will deliver your website design files and any other project deliverables as outlined in the Project Agreement.

Web Hosting: American Web Store may offer web hosting services as part of a comprehensive project package. However, web hosting is a separate service with its own terms and conditions. If you choose to utilize our web hosting services, a separate agreement detailing hosting fees, service level agreements (SLAs), and data security practices will be provided.

Third-Party Hosting: Clients have the option of using a third-party web hosting provider for their online store. In such cases, American Web Store is not responsible for any server or hosting-related issues that may arise.

Refund Policy

American Web Store strives to deliver high-quality services that meet your expectations. However, we understand that unforeseen circumstances may necessitate a refund request. Our refund policy is outlined below:

Full Refund: You are eligible for a full refund if you request it before any work has begun on your project.

Partial Refund: The refund percentage decreases as the project progresses. The specific refund percentages for various stages of project completion will be detailed in the Project Agreement. Generally, a higher percentage of the project fee may be refundable if the request is made early in the development process.

No Refund: No refunds will be granted for requests submitted after project completion or for online stores that have been launched and are live on the internet.

Refund Processing: To request a refund, please contact our customer support team via phone, email, or through the designated project communication platform. We reserve the right to approve or deny refund requests based on the terms of this agreement and the specific circumstances of your project.

Refund Timeline: Approved refunds will be processed within a reasonable timeframe, typically within 10-15 business days of the request.

Rejection to Refund Policy

There are certain scenarios where a refund request may be rejected. These include, but are not limited to:

Exceeding the designated timeframe for requesting a refund as outlined in the Project Agreement.

Requesting changes or revisions after project deliverables have been approved.

Violating the terms of this agreement or the Project Agreement.

Failing to provide necessary content or information to complete the project on time.

Delays or disruptions caused by the client's actions or inactions.

On-Hold Projects Clause

If a project remains inactive for an extended period due to a lack of communication from the client, the project may be considered "on-hold." We will attempt to contact you to reactivate the project. However, if we are unable to reach you after a reasonable timeframe (typically 14 days), the project may be archived. To resume work on an archived project, a reactivation fee may be applicable to cover the cost of restarting the project and potentially lost development time. The amount of the reactivation fee will be determined based on the complexity of the project and the amount of work required to bring it current.

Governing Law

These Terms and Conditions, and any disputes arising from them, will be governed by and construed in accordance with the laws of the State of California, United States of America. You agree to submit to the exclusive jurisdiction of the courts located in Los Angeles County, California for the resolution of any legal matters arising from this agreement.

Entire Agreement

These Terms and Conditions, along with the Project Agreement (if applicable), constitute the entire agreement between you and American Web Store regarding the use of our services and supersede any prior or contemporaneous communications, representations, or agreements.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

Amendments

We reserve the right to modify these Terms and Conditions at any time without prior written notice. Your continued use of our services following the posting of any changes constitutes your acceptance of the revised Terms. It is your responsibility to periodically review these Terms to stay informed of any updates.
